IPC Section 301

(Transfer of Malice/Transmigration of motive)

The English doctrine of Transfer of Malice/Transmigration of motive has been embodied in section 301.

Example –A intends to kill B but kills C whose death he neither intends nor knows to be likely to cause, the intention to kill C is by law attributed to him. A has committed an offence under section 301.
